Agreement for AuditVista Services
This agreement outlines the terms governing your use of AuditVista's mobile data collection, storage, and analysis services ("Service"). By using the AuditVista website ("Site") or any of its services, you agree to these terms.
Your Data Belongs to You
You retain all rights to your data. You are responsible for its legality, accuracy, and quality. If your account or subscription is terminated, AuditVista may deactivate your account immediately. After 120 days, AuditVista may delete your account and data. During this 120-day period, you can request limited access to retrieve your data if you've paid all outstanding fees. AuditVista is not liable for any termination or data deletion as long as it follows these terms. AuditVista offers data storage on its servers. If you store an excessive amount of data (e.g., large video recordings), additional charges may apply. AuditVista will notify you before taking any action.
Your Responsibilities
You are responsible for all content created using the Service, including data collection forms and submitted data. Use the Service for lawful purposes and comply with all applicable laws and regulations, including privacy laws. Notify AuditVista if your data is subject to heightened storage or protection standards. If others use the mobile app under your subscription ("App Users"), you are responsible for their use of the app, their compliance with the law, and the content they create.
Using AuditVista
AuditVista grants you a limited, non-exclusive, non-transferable license to use the Site and Service for your internal purposes. You cannot modify, reverse engineer, or copy the Site or Service. AuditVista owns all rights to the Site and Service, including intellectual property rights.
Payment and Termination
Fees for the Service are published on AuditVista's portal and may change with 30 days' notice. Ensure AuditVista has your updated payment information. Delinquent payments may result in service suspension or termination after due notice. You or AuditVista may cancel your subscription at any time. If terminated for reasons other than violating these terms or non-payment, you'll have access to your data for a limited time to migrate it.
Mobile App Usage
AuditVista offers a mobile app for data collection. Not all devices and operating systems are supported. By using the app, you agree that information about App Users may be shared with AuditVista. You're responsible for removing App User access when it's no longer authorized. AuditVista grants a limited license to use the mobile app. The license terms are in the End User License Agreement.
Intellectual Property
AuditVista owns all rights to its services, software, and any intellectual property created during this agreement. AuditVista may use your logos for marketing if you're a paying subscriber. You can revoke this permission at any time.
Warranties and Liability
The Service is provided "as is." AuditVista disclaims all warranties, including those of merchantability, fitness for a particular purpose, and non-infringement. AuditVista is not liable for errors, interruptions, or inaccuracies in the Service. AuditVista's liability is limited to the amount you paid for the Service.
Additional Provisions
You agree to indemnify AuditVista against any claims arising from your use of the Service or violation of these terms.
Disputes will be resolved through binding arbitration.
AuditVista may modify these terms or its privacy policy at any time, effective 30 days after posting.
The agreement is governed by the laws of Chennai, India.
